B. Definitions

B.1 An ”Error” is a mistake, misprint, misreading, misinterpretation, mishearing, mistranslation, spelling mistake, technical hazard, registration error, transaction error, manifest error, force majeure and/or similar. Examples of errors include, but are not limited to:

  • bets placed on events/offers that have already been decided;
  • bets containing incorrect participants;
  • bets accepted during technical problems that would otherwise not have been accepted;
  • bets placed at odds that are materially different from those available in the general market at the time the bet was placed;
  • bets offered at odds which reflect an incorrect score or else;
  • obviously incorrect odds at the time the bet was placed.

B.2 “Influence Betting” is an act, prohibited by kwiff, where an account holder, or parties acting in association with an account holder, can influence the outcome of a match or an event – directly or indirectly.

B.3 “Syndicate Betting” is an act, prohibited by kwiff, where account holders act together to place a series of bets on the same event or competition. Where there is evidence of account holders acting together in this manner kwiff reserves the right to make the relevant bets void and/or withhold payment of returns pending the outcome of subsequent investigations.

B.4 “Regular Time”, “Full Time” or “Statutory Time” is defined as interpreted by the official rules published by the respective governing association. For example, in football, full time is stipulated to be 90 minutes plus injury time but excluding extra time or penalties. Should the governing association decide to stipulate, before the start of the event, that the said event is to be played over a different duration, this will be treated as being the official rules for the event. Regular time or full time does not include any prolongation (extra time or overtime), unless explicitly stated in the bet offer.

B.5 “Live Betting” is the possibility to bet during an ongoing match or event. kwiff does not acknowledge or accept any liability whatsoever if it is not possible to place a bet or if the live score update (or any other related statistics and/or information) is not correct. At all times it is your responsibility to be aware of the status of the match and the events surrounding it such as the current score, its progression and how much time remains before the match is completed. kwiff does not accept any liability for changes to the Live Betting schedule or interruption of the Live Betting service.

C. Bet Acceptance

C.1  Bet acceptance occurs when a unique bet ID has been issued and the bet is reflected in the account history. To check if a bet has been accepted, visit the “My Bets” section of the App where details of all accepted bets are displayed.

C.2 Unless accepted in error by kwiff, once accepted, a bet will remain valid and cannot be cancelled. It is your responsibility to ensure details of the bet are correct before placing the bet.

C.3 Should a dispute arise about the acceptance (or lack of) of any transaction in  your account, the transaction log database will be the ultimate authority in deciding such matters.

C.4 The payout/potential payout value displayed when a bet is placed is for information only. For accumulator bets, where a selection is made void, the payout value will be reduced accordingly.

C.5 The kick-off time shown on the App is to be treated for information purposes only. kwiff reserves the right, at its own discretion, to suspend the betting activity at any time where it deems necessary.

C.6 Information referring to (but not limited to) gender, age, teams and/or participants is to be treated as supplementary information of which the availability and correctness cannot be treated as sufficient cause to void bets related to the match/event.

C.7 Statistics or other text/information shown on the App are to be considered as added information. kwiff does not acknowledge or accept any liability whatsoever if the information is not correct. At all times it is your responsibility to be aware of circumstances relating to an event.

D. Betting and Payout Limitations

D.1 kwiff reserves the right to limit the maximum payout on any bet or combination of bets by one account holder to £50.000 per day excluding the original stake.

D.2 kwiff reserves the right to decline, solely at its own discretion, any bet requested.

D.3 All bet selections are subject to pre-imposed limits set solely at kwiff’s discretion.

D.4  kwiff reserves the right to restrict or deny access, totally or partially, to  a user account, at its own discretion.

D.5 kwiff reserves the right to withhold payment on an event (or series of events), if there is sufficient evidence that any of the following has occurred:

  • the integrity of the event has been called into question;
  • match-rigging has taken place, or the match is under investigation for such;
  • the price(s) has been manipulated.

Evidence of the above may be based on the volume, size or pattern of bets placed with kwiff as well as information received from other betting providers or officially recognised organisations.

D.6 All bets placed can be subject to a time delay prior to acceptance (the length of which may vary). Such delay is determined by kwiff at its sole discretion.

D.7 All odds offered are subject to change. Such fluctuation is determined solely at kwiff’s discretion. Bets are only accepted at the odds available at the time the bet was accepted by kwiff.

E. Cancellation (Voiding) of Bets

E.1 A bet can be declared void, and in such circumstance, the initial stake will be returned.

E.2 kwiff reserves the right, at its own discretion, to declare a bet void, totally or partly, if in kwiff’s view and solely at kwiff’s discretion any of the following circumstances have occurred:

  • bets have been offered, placed and/or accepted due to an error;
  • syndicate betting;
  • influence betting;
  • a result has been affected by criminal actions;

  • bets placed while the App was encountering technical problems, that would otherwise not have been accepted.

E.3 All bets accepted in the following circumstances will be declared void:

Pre-match betting

  • betting effected after the event has started;

  • betting effected after a related event was underway and where conditions could have been altered in a direct and indisputable way.

Livebetting

  • betting where an incorrect price is given due to delayed or failing live coverage;
  • betting where offered odds reflected a different score than the actual;

  • betting made possible on particular offers after they have occurred, or else after an event which could normally be deemed as leading to the outcome has happened or is happening (e.g. bets placed on offers such as Next Goal Scorer while a penalty has been awarded, or is being taken).

E.4 In case of any error, bets can be voided and the stake returned to the customer regardless of whether they have been settled or not and regardless of whether they have been kwiffed or not.

E.5 Where one or more selections of an accumulator bet is made void, the bet will stand on all remaining selections. Where an accumulator bet has been kwiffed and one or more selections is made void, the new accumulated odds of the remaining selections will receive a new supercharge, of which the value will be at kwiff’s sole discretion.

E.6 Where one or more selections of an accumulator bet is pending settlement, the entire bet will remain unsettled.

E.7 Accumulator bets which combine different selections within the same event or selections of events with the same participants are not accepted where the outcome of one affects or is affected by the other. Although kwiff takes all necessary steps to prevent such possibilities, in the eventuality that this would happen, kwiff reserves the right, solely at its own discretion, to declare void all parts of the accumulator bet which include the correlated outcomes.

F. Result Settlement

F.1 All bets are settled on results published by the relevant sport’s official governing body after the match/event is finished. If no official result is available after a match/event has finished, kwiff reserves the right to await official confirmation of the result and therefore delay settlement for up to 48h.
